The better counterpoint is Sotomayor's: there exists a dumb, stupid, law - the DMCA - that this kneecaps sections of.
And, like in so many other things, the US Congress has avoided fixing dumb laws, so judges are legislating from the bench. Which is a bad habit, because of the "ratfuckery" that has been referenced in other comments.
