I know helmets are required by law to operate or ride on a motorcycle in California. I am just curious of the status of the driver in this case?

Why the down votes for a simple inquiry?? If the driver is already violating the law by not being compliant, there is an implicit likelihood the driver also violates the rules of road as well. Thus driving recklessly.
